These terms explain how you may use www.betsysburgers.co.uk, www.littledessertshop.co.uk, www.kabanyoroskitchen.co.uk and how orders for food and drink placed directly with Betsy’s Burgers, Little Dessert Shop and Kabanyoros Kitchen are handled. They also cover promotions, gift cards, competitions and table bookings.
Please read them before placing an order, purchasing a gift card or making a booking, and keep a copy for your records.

Betsy’s restaurants are operated by separate companies trading under the Betsy’s brand.
When you place an order, your purchase contract is with the company operating your selected restaurant. That company is responsible for preparing and supplying your food, fulfilling your order and providing any refund or other remedy due.
The restaurant’s business address and contact details will be provided before you place your order. The legal name of the company operating the restaurant will appear on your receipt.
In these terms, “we”, “us” and “our” mean BETSY'S HOLDINGS LTD for matters concerning operation of the website, and the relevant restaurant company for matters concerning your purchase, gift card or booking.

2. When these terms apply
These terms apply to our website and direct orders placed through it. The relevant ordering provisions also apply to telephone orders where these terms are made available before the order is accepted.
Orders placed through third-party ordering or delivery platforms may also be subject to those platforms’ terms. Please check the information provided about the seller, payments, delivery arrangements and customer support.
Additional terms for individual promotions, gift cards, competitions or bookings will be made available before you participate, purchase or book.
Nothing in these terms takes away your rights under consumer law.
3. Using our website
Please provide accurate contact, payment and delivery details. If you create an account, keep your login details secure and contact us if you suspect unauthorised access.
You must not use the website unlawfully, introduce harmful software, attempt unauthorised access, interfere with its operation or submit threatening, discriminatory or otherwise unlawful content.
We may restrict access where reasonably necessary to address misuse, fraud or a security risk.
The website’s branding, text, images and other content belong to us or our licensors. You may browse the website and save or print information for personal use. Other copying or commercial use requires permission unless the law allows it.
We may update the website or temporarily suspend access for maintenance or security reasons. External websites linked from our website have their own terms and privacy policies.
4. Menu and allergen information
Menu items, prices, opening hours and availability may vary between restaurants and ordering channels. Photographs illustrate our products; presentation may vary, but the food supplied must match its description.
Please check current allergen information before ordering. If you or anyone eating the food has an allergy or intolerance, speak directly to the restaurant before placing your order.
We will provide information about the regulated allergens in our food before you complete your purchase.
Please do not rely solely on an order note to communicate an allergy. Contact the restaurant so we can discuss ingredients, preparation arrangements and any cross-contact risks.
If we cannot safely meet an allergy-related request, we will explain this and will not accept that request.
We will not substitute an item without your agreement, including agreement about any relevant allergen differences.
5. Placing and accepting an order
Choose your restaurant, select delivery or collection where available, add your items and review your order before submitting it.
Please check your restaurant, items, quantities, customisations, address, contact details and requested time carefully.
For website orders, your order is accepted automatically when you successfully complete checkout. At that point, a binding contract is formed between you and the company operating your selected restaurant. We will send an order confirmation that you can save for your records.
For telephone orders, the contract is formed when the restaurant confirms that it accepts your order.
If a payment fails or checkout is not completed successfully, no order is accepted. If you are unsure whether an order has gone through, contact the restaurant before placing it again.
If an accepted order cannot be fulfilled because an item is unavailable or an unexpected operational or safety issue arises, we will contact you promptly. You may agree to an alternative or receive a refund for the cancelled items and any associated charges for services not provided.
6. Prices and payment
Prices are shown in pounds sterling and include VAT where applicable.
Payment methods and minimum order values are set by each restaurant and will be shown before checkout or explained before a telephone order is accepted.
Your total, including applicable delivery charges, service charges and other compulsory fees, will be displayed before you commit to paying. Optional extras will only be charged with your agreement.
The price agreed at checkout applies to your accepted order. We will not increase it afterwards without your agreement.
7. Delivery
Delivery is available only from participating restaurants and to eligible addresses. Each restaurant sets its delivery area, minimum order value and delivery charges. These will be shown before you place your order.
Delivery times are estimates unless we expressly agree a guaranteed time. We will make reasonable efforts to meet the estimate and contact you if a significant delay arises.
Please provide a correct address and telephone number and ensure someone is available to receive the order.
If we cannot deliver because the address is incorrect or nobody is available, we will make reasonable attempts to contact you. Any amount retained because of the failed delivery will be limited to reasonable losses caused by it, taking account of costs we save.
If delivery is substantially delayed or cannot be completed, contact the restaurant. We will explain the available options, including cancellation and a refund where you are entitled to them.
The restaurant company remains responsible for delivery services it arranges.
8. Collection
Please collect your order from your selected restaurant at the agreed time and bring your order reference or other reasonable proof of purchase.
If you expect to be late, contact the restaurant promptly. Prepared food can only be held for a limited period while maintaining its quality and safety.
If an order is not collected, any amount retained will be limited to reasonable losses arising from the missed collection, taking account of costs we save. This does not affect your rights where we are responsible for the problem.
9. Changing or cancelling an order
Contact the restaurant immediately if you want to change or cancel your order. Changes depend on whether preparation has started and whether the restaurant can accommodate your request.
Freshly prepared food and other products liable to deteriorate or expire rapidly are generally excluded from the usual 14-day cancellation right for online purchases. This does not affect your rights if food is faulty, unsafe or incorrectly described.
If you cancel before preparation begins, we will refund your payment in full.
If preparation has started, we may retain an amount reflecting our reasonable losses, taking account of costs we save. We will explain any deduction and refund the remaining balance.
If we cancel because we cannot fulfil your order, we will refund the amount paid for the cancelled items and any associated charges for services not provided.
10. Problems with your order and refunds
If items are missing, incorrect, damaged, unsafe or otherwise unsatisfactory, contact the restaurant as soon as reasonably possible so we can investigate and put things right.
Please provide your order reference, restaurant name and a description of the problem. Photographs may help, but we will consider any reasonable proof of purchase.
Depending on the circumstances and your legal rights, an appropriate remedy may include replacement items, a price reduction or a refund. You do not have to accept a voucher instead of a refund you are legally entitled to receive.
Do not eat food you believe may be unsafe. Do not return or post food unless we ask you to do so.
We will arrange any refund due without undue delay and explain how it will be processed. Your payment provider may need additional time to make the funds available.
Prompt reporting helps us investigate food-quality concerns, but these terms do not impose a three-day deadline on your statutory rights.
11. Promotions, gift cards, competitions and table bookings
11.1 Promotions
Each promotion will state its applicable dates, participating restaurants, eligible products, minimum spend and other restrictions.
Please enter promotional codes before completing payment. Whether offers can be combined will be stated in the relevant promotion.
Changes to an offer will not affect orders already accepted under it.
11.2 Gift cards
Betsy’s gift cards are purchased in-store and delivered digitally by email.
Each card is issued by the company operating the branch where it is purchased and can only be redeemed at that branch, either in-store or when ordering from that branch through our website.
The issuing company’s legal name and contact details will be included on your purchase receipt and in the gift-card email.
Staff will explain the available gift-card options, including their validity periods, before purchase. The validity period starts on the purchase date. Your selected validity period and expiry date will be confirmed in the gift-card email.
You may use all or part of the balance towards an eligible purchase. Any remaining balance stays available until the card expires. If your purchase exceeds the available balance, you may pay the difference using another payment method accepted by the branch.
Please check that the recipient’s email address is correct before completing your purchase. If the email does not arrive, or the digital card is lost, contact the issuing branch.
With proof of purchase, the branch can resend or replace the card, preserving its remaining balance and original expiry date. A replacement does not restore any balance already spent.
Your statutory rights are unaffected.
11.3 Competitions
We occasionally run competitions. Each competition will have separate terms available before entry.
Those terms will identify the promoter and explain eligibility, how to enter, opening and closing dates, prizes, how winners are selected and contacted, and any relevant restrictions.
11.4 Table bookings
Table bookings are available at selected restaurants. Availability and booking arrangements vary by branch.
Any deposit, booking fee, cancellation charge, arrival requirement or time limit will be clearly explained before you confirm your booking. The restaurant company accepting the booking is responsible for fulfilling it.
Cancellation charges will be limited to reasonable losses caused by the cancellation, taking account of costs saved and whether the table can be rebooked.
If the restaurant cancels your booking, it will refund any deposit or booking fee paid for that booking. Your statutory rights remain unaffected.
12. Complaints and contact
For an issue with an order, gift card or booking, contact the relevant restaurant using the details on your receipt, confirmation, gift-card email or our contact page.

Betsy’s Holdings will help direct or escalate your complaint to the relevant restaurant company. The restaurant company remains responsible for resolving issues with its orders, gift cards and bookings and providing any remedy due.
We will investigate complaints fairly and explain the outcome. If a complaint cannot be resolved, the responsible company will provide information about any applicable alternative dispute resolution arrangements and whether it will participate.
13. Personal information
Our Privacy Policy explains how personal information is used, shared and protected, and how you can exercise your data-protection rights.
Information about cookies and your choices is provided through the website’s cookie information and settings.
14. Our responsibility to you
We are responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care and skill.
Loss or damage is foreseeable if it is an obvious consequence or if both parties knew it might happen when the contract was made.
Nothing in these terms excludes or limits responsibility for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other responsibility that cannot lawfully be excluded or limited.
Your legal rights concerning the quality, safety and description of food and the standard of services remain fully applicable.
15. Changes to these terms
We may update these terms for future orders, gift-card purchases and bookings to reflect changes to our services, operating arrangements or legal requirements.
The terms made available when you place your order, purchase your gift card or make your booking apply to that transaction. Later changes will not alter an existing contract without your agreement.
16. Applicable law
These terms are governed by the law of England and Wales. If you live elsewhere in the United Kingdom, you also retain the benefit of any mandatory consumer protections that apply where you live.
Disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of your home country.
